Willem Janssen at VNG Juridische Tweedaagse and at Prorail

On 21 November, dr. Willem Janssen presented a part of his research at an (Vereniging Nederlandse Gemeenten – VNG). His presentation was titled: ‘Effective organisation of public tasks vs public procurement law’ and was attended by 30 civil cervants working at over 23 municipalities.

Public procurement law regulates public purchasing. Often it is, however, underestimated that this area of law also limits the discretion of municipalities to mandate and delegate public tasks, and to perform these tasks by themselves or in cooperation with other public entities. In practice it is therefore often not clear whether there is a legal obligation to organize a public tender. In his workshop, Janssen addressed the different ways to shape the performance of public tasks within the boundaries of public procurement law.

At the end of October, Willem Janssen also spoke about non-institutionalised cooperation at a meeting of Prorail titled: ‘Procuring with other contracting authorities’. Amongst the sixty attendees were representatives of Prorail, the Dutch Railways, Province of Zuid-Holland, Province of Noord-Brabant and Tennet.
