Laura Henderson wins EJLS (Young Scholars) General Article Prize

The European Journal of Legal Studies () awarded Dr. Laura Henderson the (Young Scholars) General Articles Prize 2018/19 for her article ‘Deciding to Repeat Differently: Iterability and Decision in Judicial Decision-Making’ (). The selection committee was composed of faculty members from the Department of Law at the European ľ¹Ï¸£ÀûÓ°ÊÓ Institute. 

Iterability and Decision in Judicial Decision-Making
The article examines the extent to which judges have a responsibility to engage in subversive legal interpretations. Dr. Laura Henderson addresses the conditions under which the judge had the responsibility to resist the crisis discourse in the seminal post-9/11 terrorism case of .

Algerian-born French philosopher 's (1930-2004) work on undecidability is brought into conversation with the American legal philosopher 's (1931-2013) classic theory of judicial interpretation.

Struggle over Meaning
The article pushes beyond Dworkin's recognition of the role of political morality in legal interpretation to show that the judge cannot engage in legal interpretation without becoming a participant in the struggle over meaning.

This article provides judges guidance in responding to their inevitable implication in this struggle.

Dr. Laura Henderson is assistant professor of international law and human rights at the Netherlands Institute of Human Rights (SIM) and the Centre for Global Challenges at the Faculty of Law, Economics and Governance. She is an associated researcher at the Montaigne Centre for Rule of Law and Administration of Justice.
