In the context of his PhD research, Willem Janssen LLM spoke to Aanbestedingscafé.nl about the conditions for public-public partnerships.

Certain partnerships can have all kinds of organisational advantages. Public procurement regulation is often, still, considered an obstacle to carry out such collaborations. According to Janssen, this presumption is false.

The discretions that the public procurement rules provide do not exclude that other areas of law, such as State aid rules, tax- and liability law could impose restrictions. ‘’When you talk about legal burdens, these should be considered in a broader context than public procurement law only’’, thus Janssen.
