Elisabetta Manunza in the Volkskrant about corruption investigations construction company FCC

In the Volkskrant of Saturday 12 October, a national Dutch newspaper, prof. dr. Elisabetta Manunza reacted on the participation of Spanish construction company Fomento de Contrucciones & Contratas (FCC) in the public procurement procedure for the renovation of a Dutch highway (A9). The company has in the past years many times been at the centre of attention in corruption and cartel investigations.

According to Manunza, Rijkswaterstaat (the contracting authority in this case, part of the Dutch Ministry of Infrastructure and Water Management) should critically evaluate the tender of FCC and possibly reject it. The room for contracting authorities to exclude certain companies from public procurement procedures, however, is limited. Dutch governments can deny the issuing of permits when there is a serious risk for integrity problems, without a judicial decision being required. In public procurement procedures, there are often much stricter legal conditions under which a tenderer can be excluded.
