The power of big technological companies as Facebook and Google and their monopoly on certain data is under attack. In Germany and in the Netherlands, both the courts and the government try to curb that power through competition law and other means. Several experts from the Faculty of Law, Economics and Governance were in the news recently, to comment on this.

Anna Gerbandy, hoogleraar mededigingsrecht en Stefan Kulk, onderzoeker op het gebied van intellectueel eigendomsrecht, gaven . De Duitse Bundeskartellamt heeft beslist dat Facebook z’n machtspositie misbruikt door zonder toestemming data te verzamelen op Instagram en Whatsapp, en tal van andere sites met ‘like’-knoppen.

Kulk zegt onder meer: "Het gaat hier om een nieuwe benadering, ik heb dit nog niet eerder gezien. Het is baanbrekend dat Duitsland dit zo aanpakt en ik verwacht ook dat niet iedereen het met de motivatie eens zal zijn. Maar ik denk dat het wel goed is dat dit gebeurt, het geeft de privacywet extra tanden."

Het Duitse denken zou ook stand kunnen houden onder het Europese mededingingsrecht. En daarmee ook het Nederlandse.

Anna Gerbrandy zegt: "Het denken van de Duitse waakhond is weliswaar gestoeld op Duitse wetgeving, maar het zou ook stand kunnen houden onder het Europese mededingingsrecht. En daarmee ook het Nederlandse." In Nederland wil D66 het monopolie op data van techreuzen als Facebook en Google aanpakken via het mededingingsrecht en .

Ook Thibault Schrepel, universitair docent in Europees Economisch Recht, gaf commentaar in de pers op deze zaak. In een Engelstalig , zegt hij: "The German decision deviates from the usual standards of competition law" by not explaining why Facebook’s market power lets it collect the data or how that creates "data barriers to entry" that shut out potential rivals, The authority is claiming to protect consumers from the company’s data collection when "in fact, it seems they benefit from this."
